An Asian-American businessman Atoo Heera Sakhrani sues purported 'Judge' Gerald Escala, the presiding 'judge' in the New Jersey Chancery Court in Bergen County, New Jersey, for 6 Counts including corruption, fraud,conspiracy and being a Bonus Partner in helping the unscrupulous Mortgage Broker, Title Agent, Insurance Companies and Lending Institutions cover up their crimes at the expense of innocent people. A major component of the lawsuit is that purported 'Judge' Gerald Escala is aiding and abetting the mortgage lenders and their attorneys in predatory lending practices schemes to steal the property from unsuspecting minorities (e.g., Asian-American senior citizen).
Purported 'Judge' Escala has a pattern of ignoring hard evidence and facts including forgeries and fraud involving the major Lending Institutions and their agents and attorneys in the Sakhrani case,and it has also been uncovered in other similar cases involving other innocent victims as well, even when they appear to be acting blatantly criminal.Escala ignored a 300-point counterclaim filed by Sakhrani. And, then he willfully and maliciously failed or refused to address the over 300-point Affidavit that was submitted to the purported 'Judge' in opposition to the lending bank's motions to dismiss. The facts were unequivocally clear: The lending institution--Ameriquest/Deutsche Bank--was involved in predatory lending practices schemes of 'packing', 'flipping' and 'equity stripping'. They failed to pay the homeowner's homeowner insurance and then forceplaced their own insurance on top of the mortgage payment. Their mortgage insurance was 4 times what the original homeowner's insurance was, thus, increasing the monthly mortgage payment amount without the borrower's knowledge.
When Sakhrani found out about this, and other nefarious dealings that the lending institution was doing, like not sending him true and correct copies of all documents he requested regarding the mortgage loan and mortgage note, Sakhrani properly and timely filed a statutory notice of rescission as required under the Federal laws. This notice of rescission has been confirmed by the United States Supreme Court as an affirmative defense to any foreclosure action and that if the lending institution failed to reply to it within the statutorily required 20 day period after the filing of the notice of rescission, the borrower keeps the property, downpayment and any monies owed, plus the lending institution has to give the borrower back any monies or collateral it took as earnest monies for payments. The lending institution failed to comply with the law and sued Sakhrani for foreclosure. After almost 3 years of intensive litigation, and constant rulings against Sakhrani, purported 'Judge' Escala circumvented all Due Process and allowed the lending institution's attorneys to get a fraudulent Final Judgment of Foreclosure without notice to Sakhrani.
The law and the facts are on the side of Sakhrani! The judges and the lawyers are not!! Purported 'Judge' Escala clearly appears to be a corrupt lap dog and a Bonus Partner for the Lending Institutions by invariably always ruling in their favor despite clear evidence of criminal acts by them. In the Sakhrani case purported 'Judge' Escala struck the Sakhrani defendants' answers, affirmative defenses and counterclaims, and when the Sakhranis filed a second suit against the Plaintiff lending institution, mortgage broker and their agents and representatives that case was also dismissed under the farcical notion that he had a pending case on the same issues already--even though it was stricken. Purported 'Judge' Escala then dismissed the second complaint as being redundant, after he struck the first set of answers, affirmative defenses and counterclaim, and then prohibited the Sakhranis from filing any further complaints or motions. This is because purported 'Judge' Escala said the pleadings were redundant and therefore frivolous. The question remains: How can the pleadings be redundant and frivolous if the purported 'Judge' struck and dismissed everything, without addressing the merits of the case???????
Purported 'Judge' Escala has little regard for the law and investigation reveals that he has maintained, for years a pattern of his seemingly corrupt practices by invariably always ruling against the innocent victims who mustered up the courage to come up against the Banks and Lending institutions. He has used the same modus operandi against other unsuspecting litigants in similar matters--striking their answers, affirmative answers and counterclaims, and then deny them any relief by prohibiting them from filing further court papers. This is a pattern of racketeering behavior by this communist totalitarian 'judge'. He should go back to Cuba because that is where is abilities as a tyrant would fit into their current regime. Purported 'Judge' Gerald Escala is supposedly of Cuban origin and clearly appears to have imported into our American courtrooms, the Fidel Castro communist totalitarian hardline style of Inquisition like the Spanish Inquisition into his own Kangaroo Court's foregone conclusions. Despite supposed oral arguments and hearings which turn out to be nothing short of being a farce in a Star-Chamber proceeding for those opposing the rich and famous Bankers, Insurance Companes, unscrupulous Attorneys, Mortgage brokers, Title Agents and their band of Bonus Partners, Escala is a perfect example of how the communists and Nazis ran their court systems to steal property, livelihoods and ultimately the lives of Jews and other 'less than humans'.
Purported 'Judge' Gerald Escala, apparently, blatantly abuses the law and hurts innocent people because he claims total immunity as a purported 'Judge'. He also shields crooked attorneys by claiming immunity for the crooked attorneys as well. Together with the protection and shield he himself is receiving from his purported Assignment 'Judge' Sybil Moses from the Bergen County Superior Court of New Jersey,he continues his outrageous acts and behaves as if he can do whatever he likes to rob people of their assets earned through blood and sweat. He gives these assets in favor of the rich and famous lawyers, while wagging his tongue out that there is nothing one can do because he is a Judge. He is El Supremo! Fidel would be proud of this communist apparatchik. Escala claims he is allegedly immune from any consequences, and as such can continue to victimize innocent people through his Kangaroo Court and Star Chamber rulings against them in New Jersey. Escala accused the Sakhranis (Asian American and Senior Citizen) of being 'indecent' and 'uncivilized', because the Sakhranis demanded his disqualification not once but at least five times.
When Sakhrani demanded that the attorneys representing the lending institution, mortgage broker and other agents and representatives produce their Bar Association licenses to practice law, his demands were ignored. They were covered by Escala. It has now been uncovered that lawyers do not have licenses to practice law. The State Executive branch can only submit licenses. The State Executive branch licenses everyone from doctors, architects, hair dressers, electricians, plumbers, etc. However, they do not license lawyers. The state supreme court purportedly licenses lawyers. But, when it was investigated, it was found out that lawyers are not licensed to practice law and therefore are perpetrating frauds against the public to steal money from them, their property and their assets. Lawyers have no right to practice law more than any layperson. The only difference is that they have a Bar Association membership card which puts them in an exclusive club of nobility outlawed by the United States Constitution and New Jersey State Constitution. The lawyers in the Sakhrani matter have perpetrated frauds and fraudulent conveyances against Sakhrani under the guise of 'color of law'. 'Color of law' actually means 'color of fraud'. In other words, 'a license to steal'.
Purported 'Judge' Gerald Escala is the purported Presiding 'Judge' at the Chancery Division, Superior Court of New Jersey, Bergen County and the public records in the Bergen County Clerk's offices (public records) in Mortgage Book 10815 page 324, shows his identity with his social security number S.S.#143-26-9662 and his wife Edith L. Escala S.S.#135-32-4012. Judge Escala and his wife Edith Escala according to the title deeds in the public records are joint owners of their residential property known as 160 Donnybrook Drive, Demarest, New Jersey 07627. Both Judge Escala and his wife are believed to own additional investment properties allegedly received through ill-gotten gains of stealing from the middle class and giving to the rich and famous bankers and their bonus partners.
